Mediation And Arbitration

When working with our clients, we typically pursue one of two types of ADR: arbitration and mediation. There are similarities between the two, most notably that they employ neutral third parties to oversee negotiations. However, there are important differences to highlight:

  • Mediation: A meditator is a single party who facilitates the discussion between both parties and their counsel. Mediators do not judge the case. Instead, they are there to help both sides reach an agreement that allows the matter to be resolved.
  • Arbitration: Whereas mediation uses a single person, arbitration typically involves a panel of several arbitrators. Perhaps the biggest difference between arbitration and mediation is that arbitration makes a final decision. The arbitration panel will review evidence, hear arguments and make an ultimate decision by majority vote.
